These Terms govern your use of PlayMatchPoint (the “Service”), including the MatchPoint mobile app and the website at playmatchpoint.app. By using the Service, you agree to these Terms. PlayMatchPoint is a competitive tennis matchmaking platform that helps players find rated matches, track their progress, and grow their tennis journey.

1) Eligibility & Accounts

• You must be 13 or older to use the Service.
• You are responsible for your account and for providing accurate information.
• We may suspend or terminate accounts for violations of these Terms or applicable law.

2) User Conduct

• Use the Service lawfully and respectfully; do not harass, threaten, or harm others.
• Do not upload illegal, infringing, defamatory, hateful, or pornographic content.
• Do not interfere with or attempt to reverse-engineer the Service.

3) Safety; Assumption of Risk

The Service facilitates matches but does not supervise players or venues. You are solely responsible for evaluating the suitability and safety of people and locations. You understand athletic activity involves inherent risks (injury, illness, property damage, death) and you voluntarily assume those risks. Meeting strangers carries risks—use caution and common sense.

4) No Medical or Coaching Advice

The Service does not provide medical advice or professional coaching.

5) Content & License

You retain ownership of content you submit (profiles, photos, badges, results). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your content to operate and improve the Service. You represent you have the necessary rights and that your content does not violate others’ rights or the law.

6) AI-Generated Content

We use AI (OpenAI ChatGPT) to generate text and images, including clan names and badges. AI output may be inaccurate, offensive, or similar to existing content and may not be reviewed by us. You are responsible for your use of AI output and must not use it to infringe intellectual property, defame, or violate privacy or other rights. To the fullest extent permitted by law, we disclaim liability for AI-generated content.

7) Intellectual Property

The Service (software, design, and trademarks) is owned by or licensed to PlayMatchPoint and protected by law. Except as expressly granted, no rights are transferred.

8) Third-Party Services

The Service integrates third-party services, including Google Sign-In and Firebase (Authentication, Firestore, Cloud Functions, Storage) and OpenAI (ChatGPT). Their terms and privacy policies apply to your use of those services.

9) Privacy

Your use of the Service is subject to our Privacy Policy, which explains data practices and account deletion.

10) Warranty Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind.

11) Limitation of Liability; Release

To the fullest extent permitted by law, PlayMatchPoint and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from your use of the Service or from meetings/athletic activity arranged through the Service. Our aggregate liability shall not exceed the greater of (a) amounts you paid to us in the prior 12 months, or (b) USD $100.

You release PlayMatchPoint from claims or damages arising out of disputes with other users or injuries/losses occurring during meetings or athletic activity arranged through the Service.

12) Indemnification

You agree to indemnify and hold harmless PlayMatchPoint and its officers, employees, and agents from claims arising out of your content, your use of the Service, your interactions with others, or your violation of these Terms or the law.

13) Termination

• We may suspend or terminate access at any time, including for violations of these Terms.
• You may stop using the Service at any time.
• Account deletion: email [email protected]; we will verify and delete eligible data subject to legal obligations.

14) DMCA / Copyright

Report alleged copyright infringement to [email protected] with your contact info, identification of the work and material, a good-faith statement, and your signature. We may remove or disable access to material.

15) Changes

We may modify the Service or these Terms. Continued use after changes means you accept the updated Terms.

16) Governing Law & Venue

New Mexico and U.S. law govern these Terms. You agree to exclusive jurisdiction and venue in New Mexico courts (jury trial waived to the extent permitted by law).
